THAW OUT KNOXVILLE 2025 – PURCHASE POLICY AND TICKET TERMS & CONDITIONS

WELCOME TO THE THAW OUT MUSIC FESTIVAL (THE “EVENT”), WHICH IS OWNED AND OPERATED BY THAW OUT KNOXVILLE LLC (THE “COMPANY,” “WE,” “US,” “OUR,” “EVENT PRODUCER”). THIS PURCHASE POLICY AND TICKET TERMS & CONDITIONS (THIS “POLICY”) CONTAINS RULES, REGULATIONS, AND OTHER DETAILS GOVERNING YOUR ATTENDANCE AT THE EVENT. PLEASE READ THIS POLICY CAREFULLY PRIOR TO PURCHASING ANY TICKET, WRISTBAND, OR PASS (COLLECTIVELY, “TICKET”). BY PURCHASING A TICKET TO THE EVENT, ATTENDING THE EVENT, AND/OR ACCEPTING AN EVENT TICKET, YOU (“YOU,” “USER”) ACKNOWLEDGE AND AGREE TO BE BOUND BY THE TERMS AND CONDITIONS SET FORTH IN THIS POLICY. IF YOU DO NOT AGREE TO THIS POLICY, PLEASE DO NOT PURCHASE A TICKET OR ATTEND THE EVENT.

THIS EVENT IS RAIN OR SHINE. ALL SALES ARE FINAL. TICKETS ARE NON-REFUNDABLE AND NON-TRANSFERABLE, EVEN IN THE EVENT OF CANCELLATION.

TICKETS EVIDENCE A REVOCABLE LICENSE TO ENTER THE EVENT PROPERTY (“PREMISES”). VIOLATION OF THIS POLICY MAY RESULT IN REVOCATION OF THE LICENSE WITHOUT PRIOR NOTICE.

• Age Requirement: All Ages (Attendees under 16 must be accompanied by an adult 18 or older)

ENGAGEMENT

By purchasing a ticket, the purchaser agrees to abide by all terms and conditions set forth by Thaw Out Knoxville LLC and acknowledges that attendance at the event is voluntary and subject to all rules and policies in place at the time of entry.

TRANSACTION INFORMATION; REVOCABLE LICENSE; REFUSAL OF ADMISSION

1. ALL SALES ARE FINAL. TICKETS ARE NON-REFUNDABLE AND NON-TRANSFERABLE, EVEN IN THE EVENT OF CANCELLATION.

2. TEN (10) TICKET LIMIT PER CUSTOMER/ACCOUNT/EMAIL/ADDRESS/CREDIT CARD. ORDERS EXCEEDING THE TICKET LIMIT ARE SUBJECT TO CANCELLATION.

3. ORDERS WILL BE REVIEWED FOR ADHERENCE TO THIS POLICY. ORDERS PLACED FOR THE SOLE PURPOSE OF RESALE ARE SUBJECT TO CANCELLATION.

4. TICKETS MAY NOT BE USED FOR ADVERTISING, PROMOTION, SWEEPSTAKES, OR OTHER COMMERCIAL PURPOSES WITHOUT EXPRESS WRITTEN CONSENT.

5. TICKETS MUST BE PURCHASED THROUGH AUTHORIZED VENDORS. ANY FRAUDULENT, DUPLICATED, OR UNAUTHORIZED TICKETS WILL BE VOIDED WITHOUT REFUND.

A TICKET TO THE EVENT IS A REVOCABLE LICENSE. WE RESERVE THE RIGHT, WITHOUT REFUND, TO REFUSE ADMISSION OR EJECT ANY PERSON WHO FAILS TO COMPLY WITH THIS POLICY, APPLICABLE LAWS, OR EVENT RULES, OR WHOSE CONDUCT IS DEEMED DISORDERLY, ANNOYING, ILLEGAL, VULGAR, ABUSIVE, OR THREATENING.

VIP & ULTRA VIP ACCESS

1. ACCESS TO DESIGNATED VIP AREAS

• ENTRY TO VIP & ULTRA VIP AREAS IS DETERMINED BY THAW OUT KNOXVILLE LLC AND IS SUBJECT TO CAPACITY LIMITATIONS.

• ACCESS IS NOT GUARANTEED AT ALL TIMES AND MAY BE TEMPORARILY RESTRICTED IF DESIGNATED VIP AREAS REACH MAXIMUM CAPACITY.

2. ROOFTOP CAPACITY RESTRICTIONS

• ATTENDEES WITH ULTRA VIP ACCESS MAY BE REQUIRED TO WAIT BEFORE ENTERING THE ROOFTOP AREA IF IT HAS REACHED ITS SAFE OCCUPANCY LIMIT.

• ENTRY WILL BE GRANTED ON A FIRST-COME, FIRST-SERVED BASIS AS SPACE BECOMES AVAILABLE.

ALCOHOL POLICY

• ONLY ATTENDEES 21 YEARS OF AGE OR OLDER MAY CONSUME ALCOHOL.

• A VALID GOVERNMENT-ISSUED PHOTO IDENTIFICATION IS REQUIRED FOR VERIFICATION AT ENTRY.

• ANY PERSON UNABLE TO PRESENT A VALID ID WILL NOT BE PERMITTED TO DRINK ALCOHOL AT THE EVENT.

WATER BOTTLE POLICY

• EACH ATTENDEE MAY BRING UP TO TWO (2) SEALED WATER BOTTLES.

• NO GLASS CONTAINERS ARE ALLOWED.

CARNIVAL GAMES & RIDES LIABILITY WAIVER

By participating in any carnival games, rides, or interactive activities, you voluntarily assume all risks associated with these activities, including the risk of personal injury, property damage, or death. Thaw Out Knoxville LLC, its staff, vendors, and sponsors are not liable for any injuries or damages resulting from participation.

LOST OR STOLEN PROPERTY DISCLAIMER

Thaw Out Knoxville LLC is not responsible for any lost, stolen, or damaged personal property at the Event, including but not limited to bags, phones, wallets, and other valuables.

NO RE-ENTRY POLICY

Re-entry to the Event is not permitted after initial entry. Any exit from the festival grounds will be considered final.

PROHIBITED CONDUCT & REMOVAL POLICY

Thaw Out Knoxville LLC reserves the right to remove any attendee from the Event without refund if they engage in:

• Disorderly conduct

• Illegal activity

• Harassment

• Violence

• Any behavior deemed unsafe or disruptive to others

WEATHER & ENVIRONMENTAL HAZARDS DISCLAIMER

Attendees acknowledge that the Event takes place outdoors and understand the risks associated with:

• Extreme weather conditions

• Uneven terrain

• Loud music & flashing lights

• Other environmental hazards

Thaw Out Knoxville LLC is not responsible for any injuries or health-related issues resulting from these conditions.

MEDICAL TREATMENT AUTHORIZATION & LIABILITY WAIVER

By attending the Event, you consent to receive medical care deemed necessary by Event staff, emergency personnel, or licensed medical professionals. Thaw Out Knoxville LLC is not liable for any medical treatment or transport provided at or after the Event.

ARTIST LINEUP & SCHEDULE CHANGES

• The Event lineup and schedule are subject to change at any time without notice.

• Thaw Out Knoxville LLC does not guarantee the appearance of any specific artist and reserves the right to substitute, reschedule, or cancel performances without refund or compensation.

• In the event of an artist cancellation, no refunds, exchanges, or credits will be issued.

• Attendees acknowledge and accept that artist lineup changes, performance delays, or cancellations are beyond the control of Thaw Out Knoxville LLC, and ticket sales remain final.

POLICY CHANGES

Thaw Out has the exclusive right to set & change ticket policies at any time.

PUBLICITY RELEASE & FILMING RIGHTS

By entering the event, attendees grant Thaw Out Knoxville LLC the unrestricted right to record, film, photograph, and capture audio and video footage of attendees for promotional, advertising, and broadcast purposes.

MISCELLANEOUS

This policy is governed by the laws of the state of Tennessee. Any legal disputes shall be resolved in Tennessee courts.
